Full Version: Reproduction Parts and Accessories

I am interested in finding out as much as I can about the legalities of reproduction parts and accessories. I have the means to basically tool and duplicate anything out there if I can get my hands on a sample. This would include rubber, decals, and all metal parts.

A Problem might be flooding the market with knock offs and having those that actually own the proprietary rights to the "Brand" that is being duped come after me for royalties or cease and assist orders. I want none of this.

I know you can open all kinds of car magazines and buy old re-production parts and accessories, how would this translate to the bike industry?

Anyone out there know how to or where to start looking for this kind of info on what is legal and illegal to duplicate?

The only reason it probably won't go nuts is Rockford. Tobin and the usual suspects are all there.....or the wi-fi at the hotel will be slow as molasses with all them on it. But I would put the over/under at 5 or 6 pages.

There are very few US Patents for BMX parts & about as many Registered Trademarks for BMX "stuff" that was made in the 1980's that are _legally_ enforceable.

Todds toothless SE logo crusade has no legal standing outside of advertising & selling the logo in Ebay , it's just an agreement made between 2 companies , it's not the law.

If you want to get into deep deep trouble , mess with Coca Cola's dynamic ribbon logo device.
The full weight of the Law & whatever Deity you most fear , will smite you without a second thought.
Genuinely BIG companies know how to properly protect their Intelectual Property they have the money & ruthless attitude to bend you over a barrel & use no lubricant......

Obviously do a some research on who you may be going to pick a fight with , but chances are slim that any old skool BMX maker that has been out of business or not making what you intend to reproduce will not have the finances to actually do anything significant about it or a legal leg to stand on.

I wouldn't give a second thought to a legal letter sent to me threatening to sue me for every penny I had if I registered the domain name www.seracingsux.com & had it plastered with oldskool SE logos everywhere & I sold exact reproductions of SE racing gear , rather than the lame padsets that don't fit onto 8 inch rise handlebars etc....


The morals , ethics etc of these practices can be argued over for eternity & be better used to fill up hot air balloons as they have no connection to the Law/Whore

If you do it don't date stamp them or stamp them repro. Make them look as original as posible. If I know this crowd they prefer that their repops be undistinguishable from originals.

Less than a page in over 12 hours? The roads and airports leading to Illinois must be packed.

As for reproducing stuff start with Nomuras, maybe some 75 Squarebacks, Schwerma Champions, and I hear there are people looking for Hutch cranks.

You guys are like the posse on the school playground who is egging on the new kid to throw sand at "that kid over there" (not explaining, of course, that "that kid over there" is the school bully who failed two grades).

But Jet Black has a point vis a vis the lengths that the majors go to to protect IP. I had a domain name "3mmc.net" in the mid 90s (it was ThirdMillenniumMediaCorporation), and every six months or so, I'd get a threatening letter from 3M's counsel warning me to step off, simply because my name contained "3M."

I kept using the name as long as I wanted to, and their threats never amounted to anything...but had they really wanted to make an issue of it, it could have been a very expensive stand for me to make.

Sometimes the all-out approach that the "Corporate IP Dragons" take can backfire, as presented by (in)famous hacker Atom Smasher in this Podcast from "The Fifth HOPE" conference http://tinyurl.com/6cbn2u. It is a good story.

I loaded up my truck last night with 75 sets of repop Comp II's to sell at the Rockford trip.

And this morning I find all 4 tires flat and the spare gone.
Tell me the corporate dragon isn't flying.

If you make hutch pedals and cranks, you will be a millionaire in about a year. To my knowledge only about 50 sets of hutch cranks were ever made. When they were being sold, Hutch couldn't even get enough of them (as they were coming out of a small machine shop). Someone please correct me if I have my facts wrong on this.

The only good "Hutch" cranks made were the one's Profile made for them & Hutch put their stickers on them. Tim Judge shows off a set of the new Profile/Hutch cranks along with a new Hutch Frame (possibly made by Speed unlimited) in a BMXA test
with lottsa skatepark & jumping pix in it , early 1980's not sure which edition.

Even the guy who made the early "collectable" Hutch aerospeeds in his small machine shop
said they were garbage or not worth the money.

Remember all this Hutch "glory" money/legend etc came outta a small mail order bike shop
from the East Coast of the US , who's owner like good quality chrome plating , stars & sponsoring Powder Puffs smile.gif
