I've been reading everybody's questions and answers, if you dont know the situation i was in and if you havent talked to me about it then yes maybe if you havent met me before then you may think im a cheater. But i would like to tell everybody alittle story and how everythimg leads to a messed up problem that really needs to be solved and im working on it!

At the christmas classic last year i ended up getting hematoma in my leg and i was out for a month. While i was at home, out of riding my bike i was recovering and getting ready to get back on it, eating alot and working out everyday yea i was on my butt for a month so i gained alittle weight like 5 pounds. I got back on my bike at morristown and my mom ended up passing away that weekend! I pretty much wanted to give up on everything in my life, from my mom commiting suicide to the random gate hitting bmx i felt like i couldnt do it anymore. But she wouldnt want me to do that. I pushed harder then ive ever pushed in my life training 100% perfect every day! I moved in with my dad and he helped me out everyday, he said just keep pushing.

Then i went to the west palm national looking to try and get 1 uci point to qualify for the worlds in china. I was riding good all weekend felt good then i got a random test on friday out of the motos, i was ok with it but i never herd anyboby getting tested out of the motos! Saturday rolled around, 15 hours later felt like i was racing pretty well qualified into the semi earned my uci point then got pulled again for another random test (HOW RANDOM) i asked her i said why are you pulling me again she said its your number, I said that's my moms number but i went with it! So i got tested twice in 1 weekend 15 hours between each other, I got my test results back 2 months later. I passed the first test but failed the second. They were telling me that i had Beleonde i think and Norandrostione i researched the 2 and found out what they were. The BELEONDE is a shot form steriod and the othere is a high testosterone! Im going to be way honest with everyone ( I have never in my life taken, shot up, or snorted anything in my life due to all of my good friends at home that are now into drugs! It tears me to pieces when i think of that stuff) Everything ive ever taken has been from GNC nothing ever illegal. Boldenone is a fast twitch steriod and it helps you loose weight and cuts you up. As what ive read. Anyways i called the UCI i needed to talk to someone about this. I told them im not to smart when it comes to understanding paper work and whats going on, ive ridin a bike my whole life and ive never had any family support. i have always been on my own.

The UCI told me i have 2 choices i can either take the suspension or get a lawyer and fight it! I told them i live on my own i work a full time job to pay my bills and to pay my rent, theres no way i can afford a lawyer and take the time off to fight this. I asked them if i could still race the NBL and the ABA and they said yes i had to talk to a few people about this to make a decision. But there was no way i could afford this time and money.. So i went ahead and signed the paper knowing i could still race and not admitting that i took steriods. The people from the UCI told me they have never herd of anyone failing a drugtest 15 hours later they said it sounds unreal and there may be something wrong. Also they told me they never herd of anyone getting tested twice in a row and that may be illegal. They told me they tested in a brand new labratory, they have never tested there before. So i took in the facts, everything went way wrong on my part. But i swear on my moms grave nothing illegal has ever went into my body. I went to the NBL grands they said i could race.. 1st moto went by, then they disqualified me! I called USADA and while i was on the phone with them i was trying to tell Erma Miller that i was on the phone with USADA she said i dont care it doesnt matter I told Bob T. he talked to Mike King, and Mike said pull me out, I tryed calling Mike King but he never returned my phone calll and i probley called him 10 times that weekend. So nobody was tring to help me. I got phone calls all weekend telling me that the UCI is slandering my name along with 20 differnt companies and presses!

All of my friends and people that im close with in the sport of bmx know that im a clean guy and im 100% dedicated to my sport and i would never do anything illegal! Im asking for people's support to help me out with any information that i may not know about the UCI or if anyone has any advice for me. I really appreiate all the help from everyone that has helped me and that is helping me. Thanks for taking the time to read and understand my situation. Thanks~ MIKE KAPES

I would look at everything you were taking suplement wise around that time and look whats in it and do some research and see if anything in there could give a false possitive. Also I would try and stay on the UCI and follow up on their statement about the double test and such.

Mike,

What exactly is in the written documentation that you have?
For each of the days testing, was there a separate A sample test and B sample test?
If so do both samples fail on the second days test?
Do they provide you with the lab documents?
Do they provide you with written information on which lab tested it.

Does anyone know what it means now that he has already signed the agreement for the 2 year ban? Wouldn't that be an admission of guilt? Does anyone know if after signing one of these things, has the UCI appeals processes been forfitted (meaning it already needs to go to a different level of hearing)?

Bob

Don't let the smack talk from a bunch on wannabe's beat you down.

If you know you were not at fault, stand up. Someone will eventually listen. Don't go down without a fight.

AND most of all never lose focus on your goal........wining.

Hope everything works out as it should.

Other random questions:

-Who advised you that you'd still be able to race ABA and NBL after signing 2 year ban agreement?
-Was that verbal or written?

-What will UCI/USADA say if you call them today and say you were previously ill-advised (told you should sign eventhough you know you're innocent) and want to know what you can do to appeal?

Bob

ps. Sorry to hear about your Mom

~ the written document is so big but it pretty much states that i failed with the ingredients and terms and conditions!
~ they tested both but its the same [I tried to curse]
~both samles yes did fail but the same is my point
~ documents yes and lab yes
~ addmission of guilt? Bob i got screwed and everyone knows that! This whole thing drives me crazy, ive been consistant my whole life i won the A Pro title last year consistantly winning the whole year! so why does it mean im on steriods if i go into a race and do ok in AA and make a semi NOT A MAIN! PMs = private message box in this forum.

Someone has sent you a personal message rather than posting it here for everyone to read. At the top right of this screen, you should see it says "1 New Messages".

By signing the document I would guess that it is a UCI ban not an ABA/NBL ban...correct?? It would seem strange that two sanctions that never cooperate on anything are now cooperating and sharing drug test results??!! Mike should read that document again VERY carefully...

I bet the decision made in Louisville was made in haste and not very well thought out...It seems the "Director of Competition=Bob T. would have hade the final decision for the NBL Grands (oops...unless the grands was also a UCI qualification event of some sort)

Bottom line....Keep your head up Mike and keep up with the paperwork and fight the UCI. Demand to know more about the procedures (samples and tests done on the samples) and carefully weigh your options.

Hi Mike,

I'm going to take the time to read your response more closely (and may have some follow up questions), but first and foremost wanted you to know that I appreciate the respect you have shown for our members and their questions by responding directly and personally. That means a lot.

More to come!

Best,

M

Mike,

It would be hard for me to form a 100% opinion without actually reading the document they had you sign, but I suspect they have what amounts to a confession. My question is this, what was the alternative to signing the document? What would have happened if you did not sign it?

Honestly, from what you have posted, I don't think you will have much success in getting it overturned. The only "positive" things you mentioned for you were verbal from someone who you cant even remember the name of. They have a signed document. So, as hard as it may be to accept, you are likely out 2 years.

PM's = Personal message. Look in the upper right side of the page and you should see a 1 message in small print.

Mike, I would try to see if you can reach out to Flyod Landis, the road bike guy. I am not sure how but you can probably look for his website or something on google and maybe send him an email. He has just been through all of this after being stripped of his tour de france win and would possibly try and help you since he was screwed over also.

Other than that I wish you a tremendous amount of luck in your fight. Try to gather as much factual information as you can about your case and your situation so that if you are able to fight it, at least you will have ammunition. Be as thorough as possible it can only help. Whether you did it, or not, none of us will ever know the truth, you are the only one who will ever know. Unfortunately, everyone else will just have to form their own opinion.
